    5. Any specific conditions contained within the various product terms and conditions shall, where appropriate, be equally applicable to all other products.

These terms and conditions are subject to change (as set out below).

    9. You are not required to participate on our website or utilise the Service, and such participation if elected by you is at your sole option, discretion and risk.

  2. Company and Regulatory information

  3. Opening an account

    1. To have access to our gambling services, you must open a deposit account with us. We do not operate credit accounts.

    6. Upon opening an account, you agree and confirm that we may email you promotional material and/or communicate with you by other means (including SMS, post, automated calls and personalised calls) about our offers, promotions, prizes, newsletters and games until such time as you communicate with us that you no longer wish to receive such communications. You agree that you will notify us by either

      1. clicking on an unsubscribe tag that is linked to these various forms of communication which enables you to opt out of receiving the promotional correspondence mentioned, or

      3. you will amend your preferences in the My Accounts section of the website for the preferences shown, or

  4. Account checking provision

    1. By registering for an Account, you agree that we may perform verification checks from time to time to confirm your personal details (including, but not limited to, your age, identity and residence) and your payment information, together the "Customer Information") that you have given us ("Verification Checks").

    2. In order to satisfy our regulatory obligations and protect the security of your Account, we may perform Verification Checks at any time during the term of the Agreement.

    3. In order to carry out the Verification Checks, we may supply the Customer Information you have given us to third party agencies. They will check the Customer Information against any databases (public or private). You agree that we may process, use, record and disclose the Customer Information you have given us and that such Customer Information may be recorded by us or them. For your protection, any communication with us may be recorded and monitored.

    4. As part of these Verification Checks, we may request additional documentation or information from you and we will advise you of such requests at the time.

    5. Whilst we are performing the Verification Checks we may restrict your access to the Service in whole or in part including but limited to, preventing the withdrawal of funds in your Account.

    6. If, following Verification Checks, we are unable to verify your Customer Information and/or you are unable or unwilling to provide such additional documentation or information that we may request as part of the Verification Checks then we will:

      1. Close your Account;

      2. Return any balance on your Account, up to the value of your deposit(s). Any winnings above your deposit(s) will not be returned; and

      3. Funds forfeited by you in this manner will be donated to a charitable organisation that focusses on education and treatment of gambling addicts and their families.

    7. If, following Verification Checks, you are found to be under 18 years of age then we will:

      1. Close Your Account;

      2. All Transactions made by you will be void;

      3. All winnings on your Account will be retained by us;

      4. All funds deposited by you, less any winnings already withdrawn, will be returned to you by a method of our choice: and

      5. Funds forfeited by you in this manner will be donated to a charitable organisation that focusses on education and treatment of gambling addicts and their families.

  5. Deposits and Withdrawals from your account

    1. Please note that all transactions are processed in American Dollars. You may be impacted by the banks currency conversion charges upon making a deposit or a withdrawal.

    3. Any deposits into your BingoLiner account will reflect in the Games application showing the cumulative player balance at that time. A personalised "My Accounts" section in the application will give more detailed analysis of gaming activity.

    4. When opening an account with a debit or credit card, you must make sure that you use your own card. The maximum number of cards that may be registered on any individual account at any given time is three.

    5. The minimum initial deposit amount accepted at the site is $20. All subsequent deposits are required to be a minimum of $20.

    6. Your withdrawal will be refunded to the most dominant deposit method used in the last 30 days. Where this is not possible, we will require an alternative payment method to be added to your account e.g. InstaDebit or iDebit.

    7. In order to comply with banking and licensing regulations, account holders may be required to provide proof of identity and/or address. The following documents may be required:

    8. Whilst these additional checks are not generally required for Debit card users, we reserve the right to request such documentation prior to processing a withdrawal, should circumstances dictate.

    9. If any sum is incorrectly credited to your account, it shall be up to you to point out this error to us. Otherwise, bets placed subsequently may be cancelled by us. You may withdraw funds from your account at any time providing all payments have been confirmed.

    10. We do not charge for deposits by Bank Transfer, Debit or Credit cards although you should note that some Credit Card Companies categorise betting transactions as `cash` and may levy a fixed and/or interest charge from the date of payment.

    11. You may only make one withdrawal request in any 24 hour period. You will forfeit all amounts held in your Bonus Bucks account when making a withdrawal.

    12. A withdrawal is pending from the time that you issue an instruction to the accounts department to make such withdrawal until the withdrawal is confirmed by the close of business for the next day, which can be up to 24 hours later.

    13. You will be required to meet the wagering requirements of slot and bingo play. For bingo you must wager 3 times and for slots 20 times the sum of all the cash bonuses awarded since the date of your last deposit that earned a bonus.

    14. You may reverse a pending withdrawal at any time prior to such withdrawal being confirmed. In such case, the balance on your Bonus Bucks account will be reinstated.

    15. We reserve the right to withhold the payment of any withdrawal to you in the event that any deposit made by you does not result in the site receiving cleared funds. We also reserve the right to declare any or all Wins null and void from the date of the deposit made by you that did not result in cleared funds.

    16. Furthermore, we reserve the right to withhold the payment of any withdrawal to you until such time as any deposit made by you has cleared and the site has received cleared funds.

    17. The time taken to process your withdrawal is subject to any player and withdrawal verification that is required.

  6. Segregation of player funds

    1. Your real money balances are retained in a segregated bank account distinct from those bank accounts utilized by the Company to operate its business. While the Company provides monthly updates to the Regulator confirming the solvency of the Company, you are advised that there are certain risks associated with these funds in the unlikely event that the Company becomes insolvent.   7. Inactive accounts

    1. If you have a free bonus account and have been inactive for one month, then you will have any balance in your account reversed.

    2. If you have been inactive for three months then you will have any bonus monies reversed from your real money account if the conditions or requirements under which such bonus monies were credited to your account have not been met.

    3. If you have been inactive for six months or more then you will have the balance on your real money accounts withdrawn, after the reversal of any bonus monies where the conditions have not been met. You will be notified of this fact by email prior to this taking effect.

    4. Funds forfeited by you due to inactivity will be donated to a charitable organisation that focusses on education and treatment of gambling addicts and their families.

  8. Closing an account

    1. We reserve the right to close your account at any time, without stating our reasons.

    2. You have the right to close an account at any time as long as you have complied with the terms stated in these terms and conditions, and providing the account does not show a balance is due to us. You should indicate your desire to close an account in writing, via e-mail or letter.

    3. Such closure shall occur within 72 hours after receipt by us of your request. You accept that you shall remain responsible for any activity on your account between advising us of your notification and the closure of your account by us. We are not liable for the non-receipt of any account closure requests.

    4. Upon closure, you shall be sent the cash balance held in the account provided that any wagering requirements have been met. Closure of an account will automatically render any open games, bonus monies, pre-purchased tickets and entries in any promotions as void.

  9. Data Privacy

    1. All information on your Account held by us is securely stored and remains confidential except where otherwise stated in the Terms and Conditions (including, for the avoidance of doubt, the Privacy Policy).

  10. Warranties, representations and covenants

    1. You warrant, represent and covenant with us (and acknowledge that we are relying on such warranties, representations and covenants) that:

      1. You are of sufficient legal age and are legally allowed to use the Service in the jurisdiction where you are located.

      2. Your use and interest in the Service is personal and you are using the Service only for your own private entertainment.

      3. You are solely responsible for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on your winnings from the Service.

      4. You agree and acknowledge that you will not provide any information or make any statement to us that is untrue, false, incorrect or misleading including in particular (but not limited to) information relating to your identity and contact details.

      5. Any and all information that you have provided to us is true (and will continue to be true) in every respect throughout the term of this Agreement and you agree to duly notify us of any changes to such information immediately.

      7. You are solely responsible for the acquisition, supply and maintenance of all of the computer equipment and telecommunications networks and Internet access services and all other consents and permissions that you need to use in order to access the Service.

      8. All monies used by you in the Service are lawfully yours and are not obtained from an illegal source.

      9. You will not deliberately take steps to prevent us from identifying your location when using the Service.

      10. You are legally able to enter into contracts.

      11. You have not been excluded from gambling.

      12. You have not already had an Account closed by us in accordance with clause 23 or at your request under clause 12 (Responsible Gambling); and

      13. You understand and accept the risk that by using the Service you may win or lose money.

  11. Username, password & Customer Information

    1. When opening a bingoliner.com account, you are required to choose a username and password that will be used to access your account. These should be kept secure. You can change your password at any time via the Options function in the application.

    2. You are responsible for the secrecy of your own Username and Password. Bets placed by third parties aware of these details will be considered valid. It is also your sole responsibility to ensure that all information supplied is accurate and up to date at all times.

    3. Usernames or nicknames may not be offensive, contain obscenities or promote other sites, or URLs.

    4. BingoLiner reserves the right to change, or request a change to any Username or nickname without further notice, that contains any of the above.

    5. Should you not comply with any request with respect to a change to your Username or Nickname then BingoLiner reserves the right to suspend your account until such time as your Username or nickname has been changed.

  12. Responsible Gambling

    1. While the majority of people do gamble responsibly, for some, gambling can become a problem. We are therefore committed to providing our customers with a responsible gambling environment.     2. You have the right to restrict your gambling by imposing self-limits on deposits or by voluntary self-exclusion.

    5. Bonuses and winnings derived from them may not be withdrawn from your account unless the wagering requirements have been met. These wagering requirements are described above in the section on Deposits and Withdrawals. Where you attempt a withdrawal and the wagering requirements have not been met, then we reserve the right to reverse the pending withdrawal. Bonus Bucks may not be withdrawn under any circumstances.

  14. Opening hours

    1. The bingoliner.com website is available to take bets 24 hours a day, 7 days a week. The only exception to this will be planned or unplanned `downtime` where our servers are unable to accept bets.

  15. Disputes

    1. If you have a dispute with the Service you should in the first instance contact us directly as soon as possible by emailing info@bingoliner.com.

  16. Age restrictions

  17. Territorial matters

  18. Other Restrictions

  19. Valid bets

    1. We do not accept bets by telephone or e-mail. Our staff cannot place bets on your behalf.

    2. We cannot be held responsible for an incorrectly placed bet or bet not being placed for any reason, including but not limited to; computer malfunctions and failure of telecommunications services or internet connections. We will not honour `bets` that have been submitted to us, but not confirmed in the manner described above.

    3. bingoliner.com accepts no responsibility for the loss of connection between a client`s Device and its Games server howsoever caused.

    4. In the event of a disconnection occurring either immediately prior to or at any stage of a game, our server will continue to automatically "play" all valid bets. Winning bets will automatically result in the crediting of the customer’s account.

    5. Where all winners have been credited for any particular game as recorded in our database, we will not issue refunds for any losing ticket, regardless of whether or not the client was able to view the ticket and/or game in question.

    1. In the event that a sum is mistakenly credited to your account we shall be entitled to make the appropriate adjustment to your account.

    2. In the event that a sum is mistakenly credited to your account, and this money is withdrawn, then you agree to reimburse us this money upon request.

  21. Intellectual Property Rights

    1. All intellectual property rights in the name "BingoLiner", the logos, designs, trademarks and other distinctive brand features of BingoLiner and any content provided by BingoLiner or any third party for inclusion on the Website vest in BingoLiner or the applicable third party. You agree not to display or use such logos, designs, trademarks and other distinctive brand features in any manner without our prior written consent.

  22. Game rules

    1. The rules governing individual games available at BingoLiner can be found on each game’s information tab. The game rules should be considered by you prior to your use of the Service.

  23. Reservation of Rights.

    We reserve the right to:

    1. Close your Account at any time without stating our reasons;

    2. Close your Account and withhold payment of monies and recover from your account the amount of any affected pay-outs, bonuses or winnings if we know or reasonably suspect you of any of the following:

      1. Being in breach of any of the provisions of this Agreement;

      2. Being in breach of any applicable law;

      3. Involvement in any form of collusion, fraudulent practice or unlawful or improper activity;

      4. Being resident in or accessing the Service from any of those jurisdictions listed in the Prohibited Countries list;

      5. Manipulation of the Service; and

      6. Use of the Service for any other purpose than for what it is intended;

    3. Deduct or reverse any funds that may have been incorrectly applied to your Account as a result of error, omission or otherwise and to void any Transactions that you may have placed using such incorrectly applied funds;

    4. Void any winnings or withdrawals from a transaction which are found to have been as a result of a malfunction and take any necessary action to correct such malfunction. A malfunction is considered to be a failure of any system or systems, hardware or software that would cause an error in the processing of a gaming transaction such that the normal processing of that transaction is interrupted and unrecoverable. Any unexpected programming error or wrong data validation which gives different results than what is expected or required will be considered a technical malfunction for these purposes.

    5. Amend the Prohibited List of countries, which may result in us having to close your Account;

    6. Request such documentation or information from you at any time for the purposes of undertaking Verification Checks and your Account may be suspended and any funds in the Account may be withheld until such documentation or information is provided by you;

    7. Close duplicate or additional accounts, and to make void any Transactions placed in duplicate or additional Accounts;

    8. Alter, change or refuse any payment method available for depositing or withdrawing funds to or from your Account for any reason;

    9. Vary the standard deposit or withdrawal limits on the Service for individual customers at our discretion;

    10. Use your Personal Information to contact you in relation to your Account;

    11. Refuse or accept only part of any Transaction made by you through your Account;

    12. Withhold a withdrawal in the event that you make a deposit without the Website receiving cleared funds. We also reserve the right to, in that case, withhold any winnings that have been won after the date of the first deposit that did not result in cleared funds;

    13. Amend the rules governing individual games available on the Service; and

  24. Chat facility

    2. When using the Chat facility you should always take the following precautions: Keep your identity private.     3. We want you to get the most out of your use of the Chat facility and therefore we insist that the following rules are observed when using it:

      9. You may not use the Chat facility to use as a forum to take up any complaints. Complaints may be sent to info@bingoliner.com 

    4. By submitting information in the Chat facility, you grant bingoliner.com a non-exclusive worldwide royalty-free perpetual non-revocable licence to use, distribute, adapt, modify, display, reproduce and transmit such information in any and all media in any manner in whole or in part without any duty to account to you. You also grant BingoLiner the right to grant licences to users of bingoliner.com to view and copy such information for personal use.

    6. bingoliner.com reserves the right to edit or delete any messages left on the Chat board, including without limitation any message which contravenes the rules above.

  25. Lotto - Conditions of Play

    1. Customer

      Customer warrants and represents to Supplier that they are not physically located at the time of placing any Customer Bet in the US or any country in which it is not permitted to participate in remote betting/gaming of the nature contemplated in these Terms.

    2. Bets

      1. Only one prize can be won per bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that bet.

      2. Customer can only bet on the Lottery Draws set out in Appendix 1. Supplier is not a lottery operator, and does not provide Customer with the opportunity to purchase lottery tickets. Customer is placing bets on the outcomes of the Lottery Draw in question.

    3. Winnings

      1. Prize Tiers 1, 2 and 3

        1. The Winnings payable in respect of each Winning Customer Bet for Prize Tiers 1, 2 & 3, will depend on the number of the Underlying Lottery Winning Tickets in the applicable Prize Tier, the number of Supplier Winning Bets in that Prize Tier, the Prize payable by the Underlying Lottery Operator for any Underlying Lottery Winning Tickets in that Prize Tier, the Underlying Lottery Jackpot in that Prize Tier, as well the additional conditions in section 25.3.5

        2. The Winnings for the applicable Prize Tier are calculated on the basis of a percentage of the amount of aggregate stakes published by the Underlying Lottery Operator as well as the distribution to that Prize Tier, or, on the basis of the jackpot published on the website of the Underlying Lottery Operator for that Prize Tier of the relevant draw of the Underlying Lottery.

      2. Only one Supplier Winning Bet If there is only one Supplier Winning Bet in the applicable Prize Tier, the Winnings payable in respect of the Winning Customer Bet are calculated as follows:  Winnings equals the Underlying Lottery Jackpot in the applicable Prize Tier divided by the No. of Underlying Lottery Jackpot Winning Tickets in that Prize Tier + 1 Example 1: There is only one Supplier Winning Bet in the Prize Tier 1 and no Underlying Lottery Winning Ticket has been announced by the Underlying Lottery Operator in Tier 1 in respect of an Underlying Lottery Jackpot in Tier 1 of $30,000,000. The Winnings payable in respect of that single Supplier Winning Bet amount to $30,000,000 (subject to additional conditions as explained in section 25.3.5)  Example 2: There is only one Supplier Winning Bet in Tier 1 and two Underlying Lottery Jackpot Winning Tickets have been announced by the Underlying Lottery Operator in Tier 1 in respect of an Underlying Lottery Jackpot in Tier 1 of $30,000,000. The Winnings payable in respect of that single Supplier Winning Bet amount to $10,000,000 (subject to additional conditions as explained in section 25.3.5)

      3. More than one Supplier Winning Bet If there is more than one Supplier Winning Bet in the applicable Prize Tier, the Winnings payable in respect of the Supplier Winning Bets in the applicable Prize Tier are calculated based on a "Share Model", consisting of three steps.

        1. Calculation of the number of shares: Number of shares = Number of Underlying Lottery Jackpot Winning Tickets in that Prize Tier + Number of Supplier Winning Bets in that Prize Tier.

        2. Calculation of Size of each share: Size of 1 share = Underlying Lottery Jackpot in that Prize Tier / Number of shares

        3. Allocation of Winnings: 1 share per Supplier Winning Bet in that Prize Category

        Example 3: There are two Supplier Winning Bets in Tier 1 and one Underlying Lottery Jackpot Winning Ticket has been announced by the Underlying Lottery Operator in Tier 1 in respect of an Underlying Lottery Jackpot in Tier 1 of $30,000,000. There are three payout shares, with a size of $10,000,000 each. The Winnings payable in respect of each Supplier Winning Bet in the Tier 1 amounts to $10,000,000 (subject to additional conditions as explained in section 25.3.5)

      4. All Prize Tiers except 1, 2 and 3

        1. Subject to 25.3.4.2, the Winnings to be paid out in respect of each Winning Customer Bet in a Prize Tier other than Prize Tiers 1, 2 and 3, shall be the amount of the Prize announced by the Underlying Lottery Operator in respect of an Underlying Lottery Winning Ticket in the respective Prize Tier.

        2. The maximum prize payable by Supplier in respect of each Winning Customer Bet in any other Prize Categories in respect of each Lottery Draw will be the relevant Prize multiplied by the number of Underlying Lottery Winning Tickets in that Prize Category divided by the higher of: (a) the number of Underlying Lottery Winning Tickets in that Prize Category and (b) the number of Supplier Winning Bets in that Prize Category.

      5. Additional pay-out conditions The following additional conditions apply to Winning Customer Bets: The Winnings in respect of a Winning Customer Bet in the applicable Prize Category will be the amount calculated in accordance with these Terms LESS the following (in the same order as shown)

        1. The amount that would have been withheld by the Underlying Lottery Operator of the relevant jurisdiction in which the underlying lottery is held if the customer had chosen to have the prize paid as a lump sum rather than over a period of time.

        2. The amount of taxes that would have been payable if the Customer would have been (or already is) a resident of the jurisdiction in which that Underlying Lottery is held.

        3. A 1.25% international money handling exchange rate fee.

        4. Any reduction needed due to the Category Prize cap shown in Appendix 1. This cap figure is the aggregate maximum payout the Supplier is obliged to make for the Lottery Draw in the corresponding Prize Category. Should the aggregate payout for that Prize Category exceed the cap then all Winning Customer Bets in that category will be reduced pro-rata to the cap/potential-payout ratio (e.g. if the potential aggregate payout of all Winning Customer Bets in that category are 100,000,000 EUR and the cap is 80,000,000 EUR then each winning bet shall be reduced by 20%).

      6. General Conditions

        1. If the Underlying Lottery Operator has not announced a Prize in the respective Prize Tier for the relevant draw of the Underlying Lottery, the Winnings payable in respect of each Winning Customer Bet in that Prize Tier will be calculated on the basis of the aggregate amounts paid in for the relevant draw of the Underlying Lottery announced by the Underlying Lottery Operator and its allocation to the winning Prize Tier.

        2. Supplier does not cover any special events that might be offered from the Underlying Lottery Operator from time to time. In such events Supplier will only pay out the Winnings as calculated by Supplier for such Prize Category, as it would have been paid by the Underlying Lottery Operator having not been such a special event.

        3. Valid Customer Bets will be placed on the next relevant Lottery Draw that takes place, provided that they are placed before the relevant Cut-Off Time for that Lottery Draw. It is up to Customer to ensure that the bet is placed before the relevant Cut-Off Time. For the avoidance of doubt, a bet placed after the Cut-Off Time or after a Lottery Draw has actually occurred will not be valid, irrespective of any automatic confirmation that may be generated.

        4. If an Underlying Lottery makes multiple draws on the same day/date, then unless otherwise specified by Supplier, Customer Bets will apply only to the main valid draw taking place on that day/date (or, where no `main` draw takes place, the first draw), and not to any other draw made by the lottery in question.

        5. If a Lottery Draw does not take place or no draw result is published or officially announced, all valid Customer Bets on that draw will stand for the rescheduled Lottery Draw (or, if there is none, the next available relevant Lottery Draw).

        6. Winnings payable in respect of each Winning Customer Bet up to and including US$50,000 will be paid to the Customer Account immediately. Winnings payable in respect of each Winning Customer Bet that exceed US$50,000 will be paid after verification of the Winning Customer Bet and subject to any Required Documentation that may be requested of the Customer by the Supplier. Withdrawals from a Customer Account by Customer will be paid after verification of the Winning Customer Bet and subject to any Required Documentation that may be requested of the Customer by the Supplier.

        7. Winnings payable in respect of each Winning Customer Bet may be paid to the Customer in a currency other than that of the denominated currency of the Underlying Lottery, as may be deemed necessary by the Supplier or the Insurer. Where such Winnings are payable in another currency the exchange rate used will be the midpoint of the relevant European Central Bank exchange rate on the date of the relevant Lottery Draw which led to the Winning Customer Bet or such other exchange rate as may be applied by the Insurer from time to time. The Customer shall bear all risk associated with any exchange or fluctuation of currency envisaged under this clause 25.3.6.7 and waives and releases the Supplier from any potential claims arising out of such currency exchange risk.

    4. Acceptance of Customer Bets

      1. All Customer bets will only be accepted if they are submitted in line with these Terms.

      2. Customer must be sure that all elements of the Customer Bet are correct: once the Customer Bet has been submitted, it cannot be cancelled or amended in any way by the Customer.

    5. Payments

      1. Payment for Customer Bets shall be as set out in this document.

      2. Winnings are tax-free in many countries, but any applicable taxes, duties, levies or withholding tax that would normally be applied to prizes/winners by the operator or authorities/government of that jurisdiction shall be charged to and paid by Customer.

    6. Rights of Supplier

      1. Non-existence of claims for Winnings

        1. Customer may not claim any Winnings from Supplier in the following circumstances:

          1. in respect of any Customer Bet placed after the relevant Cut-Off Time;

          2. in respect of any bet erroneously accepted by Supplier after the relevant Cut-Off Time;

          3. if Supplier becomes aware of an error in relation to a Customer Bet or Lottery Draw and is not, having used its best endeavours to do so, able to contact Customer to correct the error and confirm the Customer Bet before the deadline for the relevant Lottery Draw; and/or

          4. where Customer has, despite notification by Supplier, not provided the Required Documentation within 90 days of notification by Supplier.

          5. in the event that any fraudulent activity has taken place in relation to such Customer Bet

          6. where it would be unlawful to accept, process or honour the Customer Bet

        2. In making any decision as to whether Winnings are payable in accordance with this Condition 25.6.1, Supplier shall be entitled (but not obliged) to rely on information collected and provided to Supplier by Customer. Supplier shall not be obliged to make its own enquiries.

        3. The transfer of any Winnings by Supplier to Customer shall not entitle Customer to any claim over any such Winnings which Customer is legally not entitled to. Supplier may at any time reclaim Winnings transferred to Customer to the extent that Customer has no right to - in particular with respect to such Winnings to which Customer is not entitled in accordance with this Condition 25.6.1

        4. If any Customer Bet is voided in accordance with Conditions 25.6.1.1, 25.6.1.2 or 25.6.1.3, Customer may place any such bet on the next relevant Lottery Draw or have the Bet Price credited to the Customer Account. If any Customer Bet is otherwise voided by Supplier in accordance with this Condition 6.1, the relevant Bet Price associated with that Customer Bet may, in Supplier`s sole discretion, be forfeited or returned to the Customer Account, or returned to Customer by any other means available to Supplier.

      2. Other rights

        1. In the event of a dispute in respect of a Customer Bet or the payment or awarding of any Winnings, Supplier may withhold payment of the Winnings until any dispute has been resolved.

    7. Liability of Supplier

      1. Supplier will not be liable to Customer or anyone else, whether in contract, tort (including negligence), breach of statutory duty or otherwise in respect of:

        1. money lost by placing losing or invalid Customer Bets; or

        2. any losses caused arising from the misuse or unauthorised use of passwords.

      2. Supplier endeavours to ensure that the Supplier Service are available as much as is reasonably possible, but Supplier cannot and does not guarantee that

        1. the Supplier Service will be available at any specific time or for any specific period, or

        2. that the Supplier Service features, functionality or performance will meet Customer`s requirements or those of anyone else.

      3. Supplier shall not be liable for any loss or damage that may arise from the insolvency of any other party, including (without limitation) any bank with which Supplier maintains accounts.

      4. Without prejudice to any other provision of these Terms, Supplier shall not be liable to any person for:

        1. any event beyond its reasonable control including without limitation:

          1. any act of God, actual or threatened war, or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought or tempest;

          2. any power cut and/or failure or obstruction of any network, broadcasting or telecommunications service;

          3. the failure of, or damage or destruction to, or any errors caused by any computer systems or records (including, without limitation, the Supplier Platform), or any aspect of such computer systems or records; and

          4. any other action or event that prevents or hinders the placement or issue of a valid bet;

        2. delays, losses, errors or omissions in or made by the postal or other delivery service or the banking system; or

        3. the failure or malfunction of the equipment or technology of Customer or its internet service provider.


    Definitions and Interpretation

    •  "Applicable Jurisdiction" - means the jurisdiction that governs the region that is given by the customer as their place of address in their account details.

    • "Bet Price" – the applicable fixed price payable to Supplier for each Customer Bet.

    • "Customer" – the customer of the Supplier who is using the Supplier Service.

    •  "Customer Account" - the account created by the customer on the Supplier Platform through which the customer may place bets with Supplier.

    • "Customer Bet" – means a single bet placed by a Customer via the Supplier Service (regardless of whether it was placed alongside other bets) in accordance with these Terms, and accepted by the Supplier.

    • "Cut-Off Time" – 30 minutes before the relevant Lottery Draw.

    • "Insurer" – means any insurer, underwriter or other person or entity with whom the Supplier, in its sole discretion, hedges some or all of the risks arising out of or in relation to the Customer Bets from time to time.

    • "Jackpot" - the aggregate amount payable by the relevant Operator in respect of all winning tickets in Prize Category 1 of the applicable Lottery Draw, as announced by the Operator, or where no such winning ticket is announced, the amount that would have been payable by the relevant Operator had there been a winning ticket in Prize Category I of the applicable Lottery Draw, as determined by Supplier).

    • "Lottery Draw" - an official draw of the relevant Underlying Lottery.

    • "Prize" – the prize announced by an Underlying Lottery Operator in respect of an underlying Lottery Winning Ticket in the respective Prize Tier of the respective Underling Lottery.

    • "Prize Tier" or "Prize Category" - in respect of a Lottery Draw, the relevant tier of winning as determined by the amount of numbers correctly matched (including stars). Prize Category 1 being the highest prize level (the jackpot), Prize Category 2 being the second highest prize level and Category 3 being the third highest prize level.

    • "Winnings" - the amount to be paid by Supplier in respect of each Winning Customer Bet.

    • "Required Documentation" – such information and/or documentation that may be required by the Supplier to enable the payment of Winnings to Customer.

    • "Supplier" – The supplier of the tickets, Ellipse Entertainment Limited.

    • "Supplier Service" – the opportunity to place fixed odd bets on the outcome of a Lottery Draw with the Supplier.

    • "Supplier Winning Bet" - a bet placed directly or indirectly with Supplier or the Insurer that has led to winnings (including Winnings) or prizes, including (i) Customer Bets, or (ii) bets by or on behalf of any other entity using the services of the Insurer.

    • "Terms" - this document, as may be amended from time to time at the discretion of the Supplier.

    • "Underlying Lottery" – means the applicable lottery, in respect of which the Supplier is providing the Supplier Service, as listed in Appendix 1.

    • "Underlying Lottery Jackpot" – means the aggregate amount payable by the applicable Underlying Lottery Operator in respect of all Underlying Lottery Winning Ticket(s) in Prize Tier 1 of the relevant Lottery Draw of the applicable Underlying Lottery, as announced by the applicable Underlying Lottery Operator (or, where no such Underlying Lottery Winning Ticket(s) is announced, the amount that would have been payable by the applicable Underlying Lottery Operator had there been any Underlying Lottery Winning Ticket(s) in Prize Tier 1 of the relevant draw of the Underlying Lottery, as determined by the Supplier).

    • "Underlying Lottery Operator" - the relevant organisations that run the underlying lotteries as listed in Appendix 1.

    • "Underlying Lottery Winning Ticket" – a winning ticket for the relevant draw of a Lottery Draw of an Underlying Lottery.

    • "Winning Customer Bet" – a Customer Bet which is eligible for Winnings in accordance with these Terms.
